The dramatic case involving Ma-Africa hotels and stellenbosch kitchen and industry giant santam has taken a new turn as the western cape high court ruled in favor of the insured’s as regards business (BI) interuption occasioned by the covid-19 pandemic.
Ma-Afrika hotels and stellenbosch kitchen joined with insurance claims Afrika a loss adjusting firm in litigation against santam which had refused to settle their business interruption claims despite their policies covering infections or notifiable diseases. in the lenghty judgement handed down recently, the court ruled that santam was liable to pay for BI losses related to the pandemic lockdown . The court ordered santam to pay Ma-Afrika for the impact over the policy period of 18 months without limitations and their legal costs.
